Novation of otc derivative contracts

Novation is the act of either replacing a party in a contract with another or replacing one contractual obligation with another, requiring the consent of all parties involved. Novation, in contract law and business law, is the act of – replacing an obligation to perform with another obligation; or adding an obligation to perform; or replacing a party to an agreement with a new party. In international law, novation is the acquisition of territory by a sovereign state through "the gradual transformation of a right in territorio alieno into full sovereignty without any formal and unequivocal instrument to that effect intervening". A narrow scope project to amend IAS 39 Financial Instruments: Recognition and Measurement and IFRS 9 Financial Instruments to allow a novation of an over the counter (OTC) derivative that is designated as a hedging instrument, where that novation is required by legislation/regulation of an otherwise unchanged hedging instrument, to be deemed to be a continuation of the existing hedging relationship.
